1. Introduction

These Terms of Service ("Terms") govern access to and use of Axiom, the Axiom Control dashboard, and related services (collectively, the "Services"). The Services are developed and operated by Parzilous. Legal identification and address details are available in the imprint.

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Using the Services

Who can use the Services

You may use the Services only if you meet Discord's minimum age requirements, can legally agree to these Terms, and comply with applicable law. If you use the Services on behalf of an organisation or Discord server, you must have authority to do so.

Licence to use the Services

Subject to these Terms, Parzilous grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable right to access and use the Services for their intended purpose.

Acceptable use

You may not use the Services to violate law, Discord's Terms or policies, infringe the rights of others, distribute malware, evade access controls, interfere with operation of the Services, attempt unauthorised access, or intentionally abuse bugs, rate limits, or other technical safeguards.

Commercial use

Unless Parzilous gives prior permission or a separate agreement applies, you may not resell, rent, lease, redistribute, or commercially exploit the Services themselves.

3. Security

Parzilous takes reasonable measures to protect the Services and information processed through them. You are responsible for protecting your Discord account and any credentials or access you control. If you become aware of a security issue affecting Axiom, contact [email protected].

4. Suspension and Termination

Parzilous may restrict, suspend, or terminate access to the Services where reasonably necessary, including for violations of these Terms, abuse, security risks, legal requirements, or conduct that may harm the Services, Discord users, or third parties.

You may stop using the Services at any time. Server administrators can remove Axiom from their Discord server, and users may remove user-installed access through Discord where applicable.

5. Your Responsibility

You are responsible for how you configure and use the Services and for ensuring that your use complies with applicable law, Discord's rules, and the rights of others. Server administrators remain responsible for decisions they make using moderation, logging, automation, and configuration features.

To the extent permitted by applicable law, you are responsible for losses caused by your unlawful or intentionally abusive use of the Services.

6. Disclaimers

The Services are provided on an "as is" and "as available" basis. Parzilous does not guarantee uninterrupted availability, error-free operation, permanent availability of any feature, or compatibility with every future change made by Discord or a third-party provider.

Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Parzilous is not liable for indirect or consequential loss, loss of profits, loss of data, business interruption, or damage resulting from third-party services, except where liability cannot legally be limited.

Mandatory liability— including liability for intent, gross negligence, injury to life, body or health, and liability required by applicable product-liability or consumer-protection law—remains unaffected.

8. Third-Party Services

Axiom depends on Discord and may integrate with optional third-party services. Those services are governed by their own terms and policies. Parzilous is not responsible for the independent operation, availability, or policies of third-party services.

9. Dispute Resolution

If you have a dispute concerning the Services, please first contact [email protected] so that an informal resolution can be attempted.

10. Governing Law

These Terms are governed by German law to the extent permitted by applicable law. Mandatory consumer protections and mandatory rules on jurisdiction remain unaffected.

11. Changes to the Terms

Parzilous may update these Terms when the Services, legal requirements, or operating conditions change. The effective date above identifies the current version. If you do not agree to an updated version, you must stop using the Services.
